Ripple’s Chief Legal Officer, Stuart Alderoty, received widespread recognition for his leadership in Ripple’s prolonged legal fight with the U.S. Securities and Exchange Commission (SEC). Ripple CEO Brad Garlinghouse publicly praised Alderoty’s legal strategy, crediting him for steering the company toward a partial court victory that significantly impacted the crypto industry.
The SEC initially filed a lawsuit against Ripple in December 2020, claiming the company’s XRP token qualified as an unregistered security. This marked the first major instance in which the SEC applied the Howey Test to a cryptocurrency. However, Ripple, under Alderoty’s legal guidance, maintained that XRP was developed to facilitate international payments—not as a speculative investment.

Ripple Scores Legal Win in 2023 Ruling
After nearly three years of legal proceedings, U.S. District Judge Analisa Torres ruled in July 2023 that XRP, when traded on public exchanges, does not meet the legal definition of a security. This verdict undermined the SEC’s broader attempt to regulate digital assets without implementing formal guidelines.

Throughout the case, Ripple gained strong support from crypto firms, legal experts, and advocacy groups, many of which submitted amicus briefs in favor of Ripple. Alderoty consistently criticized the SEC’s lack of clear rules, arguing that companies should follow transparent regulations instead of being targeted unexpectedly.
Calls for Regulatory Clarity and Innovation
Alderoty warned that vague enforcement threatened U.S. innovation, as crypto businesses faced unexpected legal challenges. Despite spending over $150 million on legal fees, Ripple stood firm in its call for regulatory clarity. Eventually, the SEC reduced its proposed fine, choosing to retain only $50 million of the original $125 million penalty—signaling a significant concession. Beyond his work at Ripple, Alderoty now serves as president of the National Cryptocurrency Association (NCA), an organization focused on educating the public about blockchain and digital asset use cases.
